1. Agreement to Terms

By accessing and using the Alliance Rewards Club website and services ("Service"), operated by Alliance Rewards Club ("we", "us", "our", "Company", "Promoter"), you agree to be bound by these Terms and Conditions ("Terms", "Agreement"). If you do not agree to these Terms in their entirety, you must not access or use our Service.

These Terms constitute a legally binding agreement between you ("you", "your", "user", "member") and Alliance Rewards Club. We reserve the right to modify, amend, or update these Terms at any time, and such modifications will be effective immediately upon posting to the Service. Your continued use of the Service following any changes indicates your acceptance of the new Terms.

By using our Service, you represent and warrant that you have the legal capacity to enter into these Terms, that you are not prohibited from accessing or using the Service under the laws of Australia or any other applicable jurisdiction, and that you will comply with these Terms and all applicable laws and regulations.

These Terms should be read in conjunction with our Privacy Policy and Official Draw Rules, which are incorporated by reference and form part of this Agreement.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

2. Definitions

For the purposes of these Terms, the following definitions apply:

"Service" means the Alliance Rewards Club website, platform, draws, and all associated services provided by the Company.

"Member" means any person who has registered for an account and maintains an active subscription.

"Subscription" means a paid membership plan (STARTER, PREMIUM, ELITE, PLATINUM, or MEGA) that grants access to Service features and draw entries.

"Draw" means any promotional drawing conducted by the Company in which eligible Members may participate.

"Entry" means a single chance to win a Draw, allocated based on membership tier.

"Prize" means any reward, whether cash, goods, services, or experiences, offered in connection with a Draw.

"Personal Information" means information or data that identifies or could identify you, as defined by the Privacy Act 1988 (Cth).

"Account" means your registered user profile on the Service.

"Australian Consumer Law" or "ACL" means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

3. Eligibility

3.1 General Eligibility Requirements

To use our Service and participate in draws, you must:

  • Be at least 18 years of age at the time of registration
  • Be a legal resident of Australia or a jurisdiction where participation in promotional draws and membership services is permitted by law
  • Have the legal capacity to enter into binding contracts under the laws of your jurisdiction
  • Not be an employee, contractor, officer, director, or agent of Alliance Rewards Club or any affiliated entity
  • Not be an immediate family member (spouse, parent, child, sibling) or member of the household of any such person
  • Provide accurate, current, and complete information during registration and throughout your use of the Service
  • Maintain and promptly update your account information to keep it accurate, current, and complete
  • Not be prohibited from using the Service under Australian law or the laws of any other applicable jurisdiction
  • Not have been previously suspended, banned, or terminated from the Service
  • Not be located in a jurisdiction where the Service or participation in draws is prohibited by law

3.2 Age Verification

We take age restrictions seriously. You may be required to provide proof of age at any time, including but not limited to:

  • Government-issued photo identification (driver's license, passport, proof of age card)
  • Birth certificate or citizenship documentation
  • Any other documentation we deem necessary to verify your age

Failure to provide satisfactory proof of age when requested will result in immediate suspension of your account and forfeiture of any prizes won. We reserve the right to use third-party age verification services to confirm your eligibility.

3.3 Geographic Restrictions

While the Service is primarily intended for Australian residents, we may permit participation from other jurisdictions where legally permissible. However, you are solely responsible for determining whether your participation complies with the laws of your jurisdiction. If the laws of your jurisdiction prohibit participation in promotional draws, membership services, or online gaming activities, you must not use the Service.

We reserve the right to restrict access to the Service from any jurisdiction at our sole discretion. We may use IP address blocking, geolocation technology, or other methods to enforce geographic restrictions.

3.4 Eligibility Representations

By creating an account and using the Service, you represent, warrant, and covenant that:

  • You meet all eligibility requirements set forth in these Terms
  • All information you provide is truthful, accurate, and complete
  • You will maintain the accuracy of such information
  • Your use of the Service does not violate any applicable law or regulation
  • You are not using the Service for any unlawful purpose

3.5 Right to Verify and Refuse Service

We reserve the right, at any time and in our sole discretion, to:

  • Verify your eligibility to use the Service and participate in draws
  • Request additional information or documentation to confirm your identity, age, or location
  • Refuse service to anyone who does not meet eligibility requirements
  • Terminate or suspend accounts found to be in violation of eligibility requirements
  • Disqualify members who have provided false or misleading information

If you are found to be ineligible after having participated in draws or won prizes, all such participation will be deemed void, prizes will be forfeited, and you may be required to return any prizes already received. We may also pursue legal action to recover the value of prizes distributed to ineligible participants.

4. Account Registration and Security

4.1 Account Creation

To access certain features of our Service, including participation in draws, you must create an account. During the registration process, you agree to:

  • Provide accurate, complete, and current registration information, including but not limited to your full legal name, email address, phone number, and date of birth
  • Choose a secure password that meets our minimum security requirements
  • Not use offensive, inappropriate, or misleading usernames or profile information
  • Verify your email address by clicking the confirmation link sent to your registered email
  • Complete any additional verification steps we may require, including phone number verification or identity document upload

4.2 Account Security Obligations

You are solely responsible for maintaining the security and confidentiality of your account credentials. You agree to:

  • Keep your password confidential and not share it with any third party
  • Use a strong, unique password that is not used for other online services
  • Enable two-factor authentication if offered and recommended
  • Not allow others to access your account or use your credentials
  • Log out of your account when using shared or public computers
  • Immediately notify us of any unauthorized access to your account or any other security breach
  • Take reasonable steps to protect your account from unauthorized access

You acknowledge and agree that you are responsible for all activities that occur under your account, whether or not such activities were authorized by you. We will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4.3 Account Restrictions

You may not:

  • Create more than one account (duplicate accounts are strictly prohibited)
  • Share your account with any other person
  • Use another person's account without their explicit permission
  • Create an account using false information or the identity of another person
  • Create an account for anyone other than yourself
  • Transfer, sell, rent, or otherwise provide access to your account to any third party
  • Use your account for any commercial purpose not explicitly authorized by us

Violation of these restrictions may result in immediate termination of your account, forfeiture of any prizes, and potential legal action.

4.4 Account Information Updates

You must promptly update your account information if any changes occur, including but not limited to:

  • Change of email address or phone number
  • Change of residential address
  • Change of name (due to marriage, legal name change, etc.)
  • Change in payment method information

Failure to maintain accurate account information may result in inability to receive important notifications, delays in prize distribution, or account suspension.

4.5 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or any applicable laws
  • Fraudulent, abusive, or illegal activity
  • Failure to pay subscription fees when due
  • Chargebacks or payment disputes
  • Creating multiple accounts
  • Providing false or misleading information
  • Harassment of other members or staff
  • Attempts to manipulate or abuse the Service
  • Extended periods of inactivity (more than 12 months)
  • At our sole discretion for any other reason

Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated data. You will forfeit any unused entries, unclaimed prizes, and any other benefits associated with your account, unless otherwise required by law.

5. Subscription and Membership

5.1 Membership Tiers and Pricing

Alliance Rewards Club operates on a subscription-based model with the following membership tiers and entry allocations:

STARTER Membership

Price: $10 AUD per week (recurring weekly)

Entries: 10 entries per eligible draw

Billing Cycle: Weekly (every 7 days)

Benefits: Access to weekly draws, member dashboard, email notifications, blockchain verification tools

PREMIUM Membership

Price: $20 AUD per week (recurring weekly)

Entries: 25 entries per eligible draw

Billing Cycle: Weekly (every 7 days)

Benefits: All STARTER benefits plus priority support, all draws, bonus entries

ELITE Membership (MOST POPULAR)

Price: $50 AUD per week (recurring weekly)

Entries: 75 entries per eligible draw

Billing Cycle: Weekly (every 7 days)

Benefits: All draws + exclusive draws, VIP support, 2x bonus entries

PLATINUM Membership

Price: $150 AUD per week (recurring weekly)

Entries: 200 entries per eligible draw

Billing Cycle: Weekly (every 7 days)

Benefits: All + mega draws, concierge support, 3x bonus entries

MEGA Membership

Price: $250 AUD per week (recurring weekly)

Entries: 300 entries per eligible draw

Billing Cycle: Weekly (every 7 days)

Benefits: All + mega draws, white glove support, 5x bonus entries

5.2 Subscription Terms and Renewal

By subscribing to any membership tier, you agree and acknowledge that:

  • Your subscription will automatically renew at the end of each billing cycle (weekly for all tiers) unless cancelled before the renewal date
  • You authorize us and our payment processor (Stripe) to charge your designated payment method for the subscription fees at each renewal
  • Subscription fees are charged in advance at the beginning of each billing period
  • Renewal charges will be processed automatically without further action or authorization from you
  • You are responsible for ensuring your payment method remains valid and has sufficient funds
  • Failed payments may result in suspension of your membership and loss of access to Service features
  • You will receive email notification at least 3 days before each renewal (except for weekly subscriptions, which may have shorter notice)

5.3 Entry Allocation and Mechanics

Entry allocations work as follows:

  • Entries are granted automatically for each eligible draw based on your active membership tier at the time the draw entry period opens
  • You must have an active, paid subscription at the time of the draw to be eligible for entry and prize consideration
  • Entries do not carry over between draws - each draw is independent and entries are allocated specifically for that draw
  • If your membership expires, lapses, or is cancelled before a draw closes, you will not receive entries for that draw
  • If your membership is suspended or terminated, all pending entries are forfeited
  • Entry allocations cannot be purchased separately - they are exclusively tied to membership tiers
  • You cannot combine entries from multiple accounts (which are prohibited in any case)
  • Unused entries do not accumulate and cannot be rolled over to future draws
  • Bonus entries may be awarded during special promotions at our sole discretion

5.4 Price Changes

We reserve the right to change subscription prices at any time. For existing subscribers:

  • We will provide at least 30 days' notice of any price increase via email to your registered email address
  • The new pricing will take effect at your next renewal after the notice period
  • You may cancel your subscription before the new pricing takes effect without penalty
  • By continuing your subscription after receiving notice of a price change, you agree to the new pricing

5.5 Taxes and Additional Fees

All subscription prices are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. You are responsible for:

  • Any additional taxes imposed by your jurisdiction on the purchase of membership services
  • Currency conversion fees if paying with a non-AUD payment method
  • International transaction fees charged by your bank or payment provider
  • Any other fees associated with your chosen payment method

We will provide GST-compliant tax invoices for all subscription payments upon request or as required by law.

5.6 Membership Benefits and Access

Active members in good standing receive the following benefits (varying by tier):

  • Automatic entry into eligible draws based on tier allocation
  • Access to member dashboard showing entry history and draw results
  • Email notifications for draw openings, closings, and results
  • Winner announcements and verification tools
  • Customer support (level varies by tier)
  • Blockchain verification tools to confirm draw fairness
  • Access to member-only resources and educational content
  • Participation in special promotions and bonus draws

5.7 Trial Periods and Promotional Offers

We may offer trial periods or promotional pricing from time to time. If you subscribe during a promotional period:

  • The promotional terms will be clearly disclosed at the time of subscription
  • Trial periods may have limited entry allocations or draw access
  • After the trial or promotional period ends, standard pricing will apply unless you cancel
  • You will be notified before being charged standard pricing
  • Promotional offers may have specific eligibility requirements and restrictions
  • Promotional offers cannot be combined with other offers unless explicitly stated
  • We reserve the right to modify or discontinue promotional offers at any time

6. Cancellation, Refunds, and Disputes

6.1 Subscription Cancellation Process

You may cancel your subscription at any time through the following methods:

  • Accessing your account dashboard and selecting "Cancel Subscription"
  • Contacting customer support at support@alliancerewardsclub.com with your cancellation request
  • Following the cancellation link provided in your subscription confirmation emails

Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will retain access to all membership benefits, including entry into draws, until the subscription expires
  • No refund will be provided for the current billing period (except as required by Australian Consumer Law)
  • No further charges will be made to your payment method
  • After expiration, you will lose access to member-only features and will not receive entries in future draws
  • Any unclaimed prizes or pending winnings must be claimed before the membership expires
  • You may reactivate your subscription at any time by subscribing again

6.2 Refund Policy

Our refund policy is as follows:

General Refund Terms:

  • Subscription fees are generally non-refundable once paid, except as required by law
  • No refunds are provided for partial billing periods (e.g., if you cancel mid-week on a weekly subscription)
  • No refunds for unused entries or draws not participated in

Australian Consumer Law Rights:

Under the Australian Consumer Law, you are entitled to a refund if:

  • Our Service has a major failure (does not meet consumer guarantees)
  • The Service is significantly different from what was described or promoted
  • The Service is not fit for purpose or does not match the sample shown
  • We engaged in misleading or deceptive conduct
  • Other consumer guarantees under the ACL are not met

Requesting a Refund:

To request a refund on grounds permitted by law:

  • Contact support@alliancerewardsclub.com with subject line "Refund Request"
  • Provide your account email, transaction details, and reason for refund request
  • Include any supporting evidence or documentation
  • We will respond within 10 business days with a decision
  • If approved, refunds will be processed to the original payment method within 14 business days

6.3 Payment Disputes and Chargebacks

If you dispute a charge with your bank or payment provider (chargeback):

  • Your account will be immediately suspended pending resolution of the dispute
  • All entries and eligibility for current and future draws will be forfeited during the suspension
  • Any prizes won will be withheld until the dispute is resolved
  • If the chargeback is found to be fraudulent or unjustified, your account may be permanently terminated
  • You may be required to pay chargeback fees and administrative costs
  • We reserve the right to pursue legal action for fraudulent chargebacks

We strongly encourage you to contact us directly to resolve any billing concerns before initiating a chargeback with your payment provider.

6.4 Failed Payments and Account Status

If a subscription payment fails:

  • We will attempt to process the payment again within 3 days
  • You will receive email notification of the failed payment
  • If retry attempts fail, your subscription will be cancelled and your account status will change to "Expired"
  • You will lose access to member benefits and will not receive entries in future draws
  • Outstanding payment obligations remain due and payable
  • You may reactivate your subscription by updating your payment method and resubscribing

6.5 Downgrading and Upgrading Memberships

You may upgrade or downgrade your membership tier at any time:

Upgrading:

  • The upgrade takes effect immediately upon payment
  • You will be charged the prorated difference for the current billing period
  • Future billing will be at the new tier's rate and schedule
  • Entry allocations for current draws will be updated to the new tier level

Downgrading:

  • The downgrade takes effect at the end of the current billing period
  • You will continue to enjoy current tier benefits until the period ends
  • No refund is provided for the difference in tier pricing
  • Entry allocations will be adjusted to the new tier level starting from the next billing period

7. Payment Terms

7.1 Payment Processing

All payments are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. By providing payment information, you represent and warrant that:

  • You have the legal right to use the payment method provided
  • The payment information you provide is accurate and complete
  • You are authorized to make charges to the payment method
  • You authorize us and Stripe to charge all subscription fees and applicable taxes to your payment method
  • You will promptly update payment information if it changes or expires

7.2 Accepted Payment Methods

We accept the following payment methods through Stripe:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Digital wallets (Google Pay, Apple Pay) where available
  • Bank accounts (for recurring subscriptions via direct debit, where supported)

We do not store your full credit card details on our servers. Payment information is securely stored by Stripe in accordance with PCI DSS requirements.

7.3 Payment Authorization and Timing

By subscribing, you authorize us to:

  • Charge your payment method immediately upon subscription purchase
  • Automatically charge your payment method at each renewal interval (weekly, monthly, or annually depending on tier)
  • Retry failed payments up to 3 times over a 7-day period
  • Charge updated payment methods if you provide new payment information
  • Apply credits, refunds, or adjustments to your payment method as appropriate

7.4 Currency and Exchange Rates

All prices are listed in Australian Dollars (AUD). If you pay with a payment method in a different currency:

  • The amount charged will be converted to your local currency by your payment provider or bank
  • Exchange rates are determined by your payment provider, not by us
  • Currency conversion fees may apply as determined by your payment provider
  • We are not responsible for exchange rate fluctuations or conversion fees
  • The AUD price listed is the authoritative price; local currency amounts may vary

7.5 Taxes and Government Charges

Subscription prices include GST where applicable under Australian law. Additional taxes may apply based on your location:

  • If you are located outside Australia, additional taxes or duties may be imposed by your jurisdiction
  • You are solely responsible for determining and paying any taxes applicable in your jurisdiction
  • We may be required to collect additional taxes if required by law
  • Tax rates and requirements may change, and such changes will be reflected in future charges

7.6 Payment Receipt and Records

For each payment:

  • You will receive an email receipt to your registered email address
  • Receipts include transaction date, amount, subscription tier, and billing period
  • You can access payment history through your account dashboard
  • Tax invoices are available upon request for business subscribers
  • We retain payment records for a minimum of 7 years as required by Australian tax law

7.7 Payment Security and Fraud Prevention

To protect against fraud and unauthorized charges:

  • We may request additional verification for high-value transactions
  • Suspicious payment patterns may trigger account review or temporary suspension
  • We may decline payments that fail fraud screening checks
  • Multiple failed payment attempts may result in temporary account restrictions
  • We cooperate with law enforcement on payment fraud investigations

8. Prize Draws, Winners, and Claims

Detailed rules governing prize draws, selection of winners, and prize claims are set forth in our Official Draw Rules. The following provisions supplement those rules:

8.1 Draw Participation Requirements

To participate in draws and be eligible to win prizes:

  • You must have an active, paid subscription at the time the draw entry period opens and when the draw is conducted
  • Your account must be in good standing (not suspended, terminated, or in violation of Terms)
  • You must meet all eligibility requirements set forth in Section 3
  • You must not be in breach of these Terms or the Official Draw Rules
  • Entry allocations are automatic - no manual action is required to enter
  • You cannot opt out of specific draws while maintaining your subscription

8.2 Winner Selection and Notification

Winners are selected using a provably fair, blockchain-verified random selection process (详见官方抽奖规则). Upon being selected as a winner:

  • You will be notified via email to your registered email address within 48 hours of the draw
  • You will receive an in-app notification in your member dashboard
  • Your win will be announced publicly on the Alliance Rewards Club website (unless you request anonymity for valid safety/privacy reasons)
  • It is your responsibility to check your email and account regularly for winner notifications
  • We are not responsible for notification failures due to incorrect email addresses, spam filters, email delivery issues, or failure to check your account

8.3 Prize Claim Requirements and Deadlines

Winners must claim prizes within 30 days of notification. To claim a prize, you must:

  • Respond to the winner notification email within 30 days
  • Complete and submit a prize claim form with required information
  • Provide government-issued photo identification (driver's license, passport)
  • Provide proof of address (utility bill, bank statement dated within 3 months)
  • For prizes valued over AUD $1,000: provide Tax File Number (TFN) or Australian Business Number (ABN)
  • Sign a declaration of eligibility and compliance with Terms
  • Grant permission for use of name and likeness for promotional purposes (or request anonymity if desired)
  • Provide bank account details for cash prizes or delivery address for physical prizes

Failure to respond within 30 days or failure to provide required documentation will result in forfeiture of the prize. Forfeited prizes may be redistributed in future draws or donated to charity at our sole discretion.

8.4 Prize Verification and Fraud Prevention

All winners are subject to verification before receiving prizes. We reserve the right to:

  • Verify your identity, age, and eligibility through third-party verification services
  • Request additional documentation beyond standard requirements if fraud is suspected
  • Conduct background checks for high-value prizes
  • Delay prize distribution pending completion of verification
  • Disqualify winners who fail verification or are found to be ineligible
  • Withhold prizes if fraudulent activity is detected
  • Report suspected fraud to law enforcement authorities

8.5 Prize Values and Substitution

Regarding prize values and substitutions:

  • Prize values stated are approximate retail values at the time of announcement
  • Actual prize values may vary due to market conditions, availability, or other factors
  • We reserve the right to substitute prizes with items of equal or greater value if advertised prizes become unavailable
  • Cash alternatives may be offered for physical prizes at our discretion
  • Prize modifications or substitutions will be communicated to winners before prize distribution
  • Winners may not request cash equivalents for non-cash prizes unless we offer such an option
  • No prize transfers or assignments are permitted

8.6 Tax Obligations and Reporting

Winners are solely responsible for any and all tax obligations associated with prizes:

  • Prize winnings may be subject to Australian income tax depending on the value and your circumstances
  • We will provide documentation necessary for tax reporting purposes
  • For prizes valued at AUD $1,000 or more, we may withhold taxes as required by law
  • Winners must provide a valid TFN or ABN for prizes over AUD $1,000
  • We may report prize distributions to the Australian Taxation Office (ATO) as required by law
  • Winners should consult a tax professional regarding their specific tax obligations
  • Failure to provide required tax information may result in withholding of prizes or withholding of taxes at maximum rates

8.7 Prize Distribution Timeline

Prize distribution timelines are as follows (subject to verification completion):

  • Cash prizes: 7-14 business days after verification via direct bank transfer
  • Physical prizes: 14-30 business days after verification (subject to availability and shipping)
  • Experience prizes: Coordinated with winner within 60 days (subject to availability and scheduling)
  • Gift cards/vouchers: 5-10 business days after verification via email or mail

Delays may occur due to verification requirements, prize availability, shipping constraints, or other factors beyond our control.

8.8 Prize Entitlement and Account Status

Entitlement to claim and receive prizes is contingent upon maintaining an active, paid subscription and account in good standing:

  • To be eligible to claim a prize, your membership subscription must be current and paid in full at the time of the draw and at the time of prize distribution
  • If your account has any overdue payments, failed payment attempts, or unpaid subscription fees at the time a prize is to be awarded, we reserve the right to withhold prize distribution until all outstanding amounts are paid in full
  • Members with accounts in "PAST_DUE" status are not entitled to receive prizes until their account is brought current
  • If you win a prize while your subscription is active but your account subsequently becomes overdue before prize distribution, you must bring your account current before the prize will be released
  • Outstanding fees must be settled within 14 days of winning notification, or the prize may be forfeited and redistributed
  • This provision does not apply if the payment failure is due to our error or technical issues on our end

This requirement ensures fairness to all paying members and maintains the financial sustainability of the prize program. We will make reasonable efforts to notify you of payment issues and provide opportunity to rectify before forfeiting any prize.

8.9 Discretionary Prize Determination

Notwithstanding any other provision in these Terms, Alliance Rewards Club reserves the absolute and unfettered right, exercisable in our sole and exclusive discretion, to refuse, withhold, suspend, or deny the awarding or distribution of any prize to any member or winner for any reason or for no reason, without prior notice and without liability, including but not limited to:

  • Suspected or confirmed violation of these Terms, Official Draw Rules, or any applicable laws or regulations
  • Suspected or confirmed fraudulent activity, misrepresentation, or manipulation of the draw system
  • Account anomalies, irregularities, or suspicious patterns that warrant further investigation
  • Failure to satisfy verification requirements or provide requested documentation
  • Concerns regarding eligibility, identity verification, or entitlement to participate
  • Pending investigations into account activity or compliance matters
  • Disputes, chargebacks, or payment-related issues
  • Circumstances where awarding the prize would be contrary to the spirit of fair play or the integrity of the Service
  • Legal, regulatory, or compliance concerns
  • Where we have reasonable grounds to believe that awarding the prize would not be in the best interests of the Service, other members, or the public
  • Any other reason we deem appropriate in our sole discretion

This discretionary authority is exercised in accordance with Australian law and subject to the Australian Consumer Law. Where we refuse to award a prize pursuant to this provision:

  • We will provide written notification to the affected person where reasonably practicable
  • We are not obligated to provide detailed reasons for the refusal, but may do so at our discretion
  • The decision is final and binding, subject only to rights under Australian Consumer Law
  • No compensation, substitute prize, or alternative consideration will be provided
  • The prize may be forfeited, redistributed in a subsequent draw, or donated to charity at our sole discretion
  • We will not be liable for any loss, disappointment, or other damages arising from the exercise of this discretion

This provision is necessary to protect the integrity of our draws, maintain fairness for all members, comply with legal and regulatory obligations, and prevent fraud and abuse. By accepting a prize, you agree to:

  • Allow us to announce your name and general location (city/state) publicly on our website and promotional materials
  • Participate in winner announcements, interviews, or promotional content if requested (reasonable accommodation provided)
  • Grant us permission to use your name, likeness, photograph, voice, and testimonials for promotional purposes without additional compensation
  • Allow us to publish photos or videos of prize presentations or delivery
  • Feature your win in marketing materials, social media posts, and advertisements

9. Prohibited Conduct and Account Actions

9.1 General Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
  • Submit false or misleading information
  • Upload or transmit viruses, malware, ransomware, or any other malicious code
  • Spam, phish, pharm, pretext, spider, crawl, or scrape the Service

  • Sell, trade, or otherwise transfer your account to another party

9.2 Draw and System Manipulation

The following activities related to draws and the Service system are strictly prohibited:

  • Creating multiple accounts to gain unfair advantage in draws (explicitly prohibited)
  • Using automated systems, bots, scripts, or other automated means to access or interact with the Service
  • Attempting to manipulate, exploit, hack, reverse engineer, or interfere with the draw system
  • Attempting to access, probe, or test the vulnerability of any system or network
  • Attempting to decipher, decompile, disassemble, or reverse engineer any software comprising or making up the Service
  • Bypassing or circumventing any security features or access controls
  • Colluding with other members to manipulate draw outcomes
  • Sharing account credentials to pool entries
  • Exploiting bugs, glitches, or vulnerabilities for personal gain
  • Interfering with the blockchain verification system

Any attempt to manipulate the draw system or gain unfair advantage will result in immediate termination, forfeiture of all prizes, and potential legal action.

9.3 Account and Payment Fraud

The following fraudulent activities are strictly prohibited:

  • Using stolen credit cards, payment information, or another person's payment method without authorization
  • Initiating fraudulent chargebacks or payment disputes
  • Creating accounts with false or fraudulent information
  • Using another person's identity to create or access an account
  • Money laundering or using the Service to process illicit funds
  • Testing credit card numbers through multiple small transactions
  • Claiming prizes using false documentation or identity
  • Colluding to claim prizes on behalf of ineligible persons

9.4 Content and Communication Violations

If the Service includes user-generated content features (testimonials, comments, etc.), you agree not to:

  • Post content that is illegal, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity

  • Disqualification from current and future draws
  • Forfeiture of all prizes, entries, and account balances
  • No refund of subscription fees
  • Reporting to law enforcement authorities
  • Legal action to recover damages, including attorney fees and costs
  • Injunctive relief to prevent further violations
  • Banning from creating future accounts

9.6 Reporting Violations

10. Intellectual Property Rights

10.1 Company Intellectual Property

The "Alliance Rewards Club" name and logo, along with all related names, logos, product and service names, designs, and slogans, are trademarks of Alliance Rewards Club or its affiliates or licensors. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

10.2 Limited License to Use Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

  • In the case of goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of having the goods replaced, repaired, or equivalent goods supplied

  • Power outages, telecommunications failures, or internet service provider failures
  • Cyberattacks, hacking, or distributed denial-of-service attacks
  • Failures of third-party service providers (Stripe, hosting providers, etc.)

13. Indemnification

You agree to defend, indemnify, and hold harmless Alliance Rewards Club, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms or any applicable laws or regulations
  • Your violation of any rights of a third party, including intellectual property rights, privacy rights, or contractual rights
  • Any fraudulent, unlawful, or wrongful conduct by you
  • Any User Content you submit, post, or transmit through the Service
  • Your breach of any representations, warranties, or covenants made in these Terms
  • Any claim that your User Content caused damage to a third party

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. This indemnification obligation will survive termination of these Terms and your use of the Service.

14. Termination

14.1 Termination by You

You may terminate your account and subscription at any time by:

Upon voluntary termination, you will retain access until the end of your current billing period, but no refunds will be provided for the current period.

14.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms or any applicable laws
  • Fraudulent, abusive, or illegal activity
  • Failure to pay subscription fees
  • Creating multiple accounts
  • Manipulation or abuse of the Service or draw system
  • Harassment of other members or staff
  • Violation of intellectual property rights
  • Requests from law enforcement or governmental agencies
  • Extended periods of inactivity (12+ months)
  • Discontinuation or material modification of the Service
  • At our sole discretion

14.3 Effect of Termination

Upon termination of your account by either party:

  • Your right to access and use the Service immediately ceases
  • We may delete your account and all associated data
  • You forfeit any unused entries, unclaimed prizes, and account benefits (except where prohibited by law)
  • You remain liable for any outstanding payment obligations
  • You must cease all use of Company Content and trademarks
  • All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability

If your account is terminated for cause (violation of Terms), no refunds will be provided, and you may be prohibited from creating new accounts in the future.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.

15.2 Jurisdiction

You irrevocably agree that the courts of Queensland, Australia shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

Notwithstanding the above, we may seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property rights or confidential information.

15.3 Informal Dispute Resolution

Before initiating any formal legal proceedings, you agree to first contact us at support@alliancerewardsclub.com to attempt to resolve the dispute informally. Please provide:

  • A detailed description of the dispute
  • Your account information
  • What resolution you are seeking
  • Any supporting documentation

We will make reasonable, good-faith efforts to resolve disputes informally within 30 days. If we cannot resolve the dispute within this timeframe, either party may proceed with formal legal action.

15.4 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15.5 Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

We reserve the right to modify, amend, or update these Terms at any time in our sole discretion. When we make changes:

  • We may post a notice on the Service highlighting the changes
  • Changes will be effective immediately upon posting unless otherwise stated

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

16.2 Entire Agreement

These Terms, together with our Privacy Policy and Official Draw Rules, constitute the entire agreement between you and Alliance Rewards Club regarding the use of the Service and supersede all prior agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter of these Terms.

16.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent. If modification is not possible, the invalid provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

16.4 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.5 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder, in whole or in part, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may freely assign or transfer these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.

16.6 No Third-Party Beneficiaries

These Terms are for the sole benefit of you and Alliance Rewards Club. Nothing in these Terms, express or implied, is intended to or shall confer upon any third party any legal or equitable right, benefit, or remedy of any nature whatsoever.

16.7 Notices

All notices, requests, demands, and other communications required or permitted under these Terms shall be in writing and shall be deemed to have been duly given:

You are responsible for maintaining a current email address on file with us.

16.8 Relationship of the Parties

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and Alliance Rewards Club. You have no authority to bind us or make commitments on our behalf.

The headings and captions used in these Terms are for convenience only and shall not affect the interpretation of these Terms.

16.10 Language

These Terms are drafted in English. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.
